This won’t be an easy post. Nothing about cancer is. And when the patient is your 17 yr old son? It is harder still. Jesse has acute T-cell lymphoblastic Leukemia (T-ALL). His treatment will last 2-3 years & impact his junior and senior years. The next few weeks will be a whirlwind - and very difficult for Jesse. We have already logged 26 hospital nights (both on the oncology floor and in the ICU) based on how aggressive his treatments need to be: a necessary function of a cancer equally aggressive. Please pray for Jesse’s pain level and endurance. His brother Noah and sister Grace back at their respective colleges and will need their own type of strength to do the work before them. Please pray for their peace of mind. One thing is clear in all of this: God’s purpose in this trial is a good one, and He is continually trustworthy. He is good, all the time. “The Lord watches over your coming and going both now and forevermore.” Psalm 121:8 I am beyond grateful for the help of dear colleagues and friends and especially to @nickineily @malcolm_john @AmySwearer and @cullystimson who have exceeded every kindness I thought possible, and who put together this way to help: givesendgo.com/supporting-je….

A Michigan School District is still using racial hiring quotas despite the Supreme Court's ruling in SFFA v. Harvard. “The Supreme Court could not have been clearer in Students for Fair Admissions: public institutions that take federal money must treat people as individuals, not as representatives of a racial group.” - @SarahPPerry nationalreview.com/news/mich…

⏰SCOTUS grants cert in another school case: In Assoc. for ED. Fairness v. Montgomery Bd. of Ed., the Court will determine whether a plaintiff challenging a facially neutral admissions policy as racially discriminatory must establish that the targeted racial group suffered an aggregate disparate impact. Since the Court's ruling in Village of Arlington Heights v. Metropolitan Housing Development Corp. (1977), circuits have split over disparate-impact liability in school admissions, and the Court will tackle that split head-on this term. This is a timely grant, coming on the heels of the DOJ's final rule eliminating disparate-impact liability from its Title VI regulations. Students for Fair Admission v. Harvard was anything but the last word on using race in education.

The Trump admin will soon decide whether to strip the American Bar Association’s (ABA) law school accrediting arm of federal recognition. "These law students are actually going to get a better education. Because we get the ABA meddling away from curricular inclusions, and we get them away from race mandates in admissions and in hiring and promotions, we get back to ground zero on making excellent lawyers." -@SarahPPerry of @DefendingEd

I will never forget watching his confirmation hearing, in which he said he would rather die than back down from bullies. His tenacity, integrity, & intellect were as evident then as they have been in all of his opinions, since. Congratulations, Justice Thomas.
35 years ago today, Clarence Thomas was confirmed to the U.S. Supreme Court by the Senate. Growing up in segregated Georgia, he rose to become one of the greatest Supreme Court justices in American history. The Court and our country are better off today because of him.

He was right. And it was. Obergefell was not our nation’s slippery slope - but its judicial cliff from which all manner of identitarianism has sprung. Alito’s Obergefell dissent was prescient as he is.
Supreme Court Justice Samuel Alito says in a new book that he believes the court's landmark decision extending marriage rights to same-sex couples was "perhaps the decisive point in our nation's turn against religious liberty." Read more: abcnews.link/M860KYr

Seems like a perfect day to share this trove of information about the NSBA letter and the insanity that followed. defendinged.org/nsba/
Today, the Justice Department’s Weaponization Working Group issued a report detailing how Biden Administration officials at the Department of Justice explored avenues to prosecute parents and protestors who spoke to school boards and school officials during the Covid-19 pandemic. Records show Biden White House and Justice Department leadership pushed for a memo which sought to find a federal “hook” to prosecute parents and charge protestors with federal crimes, despite widespread concerns from attorneys and agents. This report follows letters sent earlier today by Department of Justice and @usedgov leadership to all 50 state attorneys general on parental rights. Read more about the report here: justice.gov/opa/pr/weaponiza…

Our new report at a glance. How did your state do?

Our new report at @DefendingEd just dropped. This is a first-of-its-kind ranking of all 50 states on the cultural issues that matter most to parents: gender & sexuality, DEI, foreign influence, unions, & parental rights. Tennessee tops the list! Where does your state rank?
Tennessee tops the nation in a first-ever ranking of all 50 states on the education battles gripping classrooms — and red states dominated the board. Defending Education's new report scores every state and Washington, D.C., across five categories: parental rights, DEI, gender and sexuality, teacher and union policies, and foreign influence. Alabama, Florida, North Carolina and Iowa rounded out the top five. Washington, D.C., ranked dead last, followed by Rhode Island, California, Oregon and Illinois. The rankings don't measure test scores or graduation rates. Instead, they track how states are handling the hot-button policy fights parents have been demanding answers on — from transgender athletes in women's sports to Chinese government influence in schools to restrictions on DEI initiatives. Seven red states received perfect scores on laws restricting Chinese government influence in education, including bans on Confucius Institutes. Full story here foxnews.com/politics/states-…

Finally - the national nightmare of Biden’s Title IX’s rewrite (enjoined or vacated by no fewer than 11 federal courts) - comes to an end. Today, @usedgov has formally rescinded the rule, removing it from the federal register.
Today, the Trump Administration is formally putting into regulation what the law has said all along: Title IX’s protections are based on SEX, not “gender identity.”

Do drag show restrictions on public university campuses violate the First Amendment? Today, the en banc 5th Circuit Court of Appeals will hear arguments on that issue.
Federal judges reached opposite conclusions on two Texas A&M drag-show bans. In a few minutes, all 17 judges on the 5th Circuit will hear both cases and consider whether public universities can bar such performances without violating the First Amendment texastribune.org/2026/09/23/…

⁨It has been three years since the Court's ruling in SFFA v. Harvard, and institutions still continue to defy the decision. It’s clear that higher education isn’t inclined to comply on its own. “The court’s ruling was clear enough. What’s missing is enforcement with teeth. Right now, an institution caught running a race-proxy scheme risks, at worst, a strongly worded finding and a promise to do better. That’s not a deterrent; it’s a cost of doing business, no different than a compliance fine a hedge fund writes off before lunch.”
