Subject: Request to Suspend Entry of Nonimmigrant Work Visa Classes and End Related Employment Authorization (Including H-4 EAD) Under Existing Executive Authority
Dear President Trump,
I am writing to respectfully request that you use your authority under section 212(f) of the Immigration and Nationality Act (8 U.S.C. § 1182(f)), together with related executive and agency powers, to protect American workers by suspending the entry of foreign nationals under nonimmigrant work visa classes and ending discretionary employment authorization that was created by regulation rather than by Congress.
I urge a presidential proclamation under INA § 212(f) suspending the entry of aliens seeking admission in the following nonimmigrant work and related dependent categories (for individuals outside the United States who lack a valid visa as of the effective date), with appropriate national-interest and other limited exemptions consistent with past practice:
H-1B (specialty occupation), H-1B1, H-2B (temporary non-agricultural), H-3, and H-4 dependents
L-1 (intracompany transferee) and L-2 dependents
O-1 / O-2 (extraordinary ability) and O-3 dependents
P-1 / P-2 / P-3 (athletes, artists, entertainers) and P-4 dependents
E-1 / E-2 / E-3 (treaty trader, investor, and Australian specialty) and dependents
TN (USMCA/NAFTA professionals) and TD dependents
Selected J-1 categories that permit work (intern, trainee, teacher, camp counselor, au pair, summer work travel) and J-2 dependents
Any other nonimmigrant classifications primarily used for employment or open-market work authorization.
These categories have been associated with wage suppression, displacement of U.S. workers, and program abuse. Prior use of § 212(f) (including Proclamation 10052) demonstrated that temporary suspension of entry for H-1B, H-2B, certain J-1, and L-1 classes is both feasible and effective. Broader or nationality-based restrictions on other nonimmigrant classes have likewise been implemented successfully when warranted.
Separately, I request that you direct the Department of Homeland Security and U.S. Citizenship and Immigration Services to promptly initiate and complete notice-and-comment rulemaking to rescind or sharply limit employment authorization for H-4 dependent spouses (the 2015 rule creating 8 CFR § 274a.12(c)(26)) and for other discretionary EAD categories that Congress did not specifically authorize. The H-4 EAD was created by regulation in 2015, not by statute or by a pure presidential order that can be reversed by proclamation alone. Because it is a formal regulation, it can be ended by a subsequent administration through the standard Administrative Procedure Act process.
Your first administration advanced such a rescission; the current regulatory agenda lists a similar action. Directing agencies to prioritize and finalize the rescission of H-4 EAD (and analogous discretionary EADs) would restore the original purpose of dependent status and prioritize American workers. Existing valid documents could be addressed through appropriate transition provisions in any final rule. A carefully drafted combination of a § 212(f) proclamation (for entry of the underlying visa classes) and directed agency rulemaking (for EADs) would advance U.S. economic and labor-market interests without requiring new legislation. I encourage you to task the Secretaries of State, Homeland Security, and Labor with rapid implementation, clear exemptions only where truly in the national interest, and related regulatory measures that further protect the domestic workforce.Thank you for your consideration and for your continued efforts on behalf of the American people.Respectfully,
