📷 JUSTICE FOR INNOCENT MEN SCOTLAND — ACCOUNTABILITY MUST FOLLOW INJUSTICE
Justice for Innocent Men Scotland welcomes any lawful and legitimate effort to hold the Scottish Government accountable if failures in the justice system have resulted in people being denied their fundamental right to a fair trial.
The headlines are now focusing on the prospect of mass legal action following the Supreme Court's ruling on evidence in Scottish sexual offence trials.
But while the potential financial consequences are being discussed, we must not lose sight of the bigger issue: the right to a fair trial is a fundamental human right, not a technicality.
If the way evidence was handled in Scottish courts risked infringing defendants' human rights, serious questions must be asked about the convictions secured under that approach.
Between 2013 and 2025, cases may have been affected. This demands proper scrutiny, transparency and accountability.
What about the men who have consistently maintained their innocence?
What about those who believe evidence that could have assisted their defence was excluded? What about the years spent in prison, the families separated, the reputations destroyed and the lives that may never be rebuilt?
We are not claiming that every conviction during this period is unsafe, or that every convicted person is innocent. But neither should the possibility of injustice be dismissed simply because investigating it may be costly or uncomfortable.
Justice for Innocent Men Scotland calls for:
📷 Proper scrutiny of potentially affected convictions from 2013 to 2025.
📷 Particular attention to cases involving men who continue to maintain their innocence.
📷 Transparency about the implications of the Supreme Court's ruling.
📷 Accountability wherever failures or infringements of fair-trial rights are established.
📷 Appropriate legal remedies for those who can demonstrate that they have suffered an injustice.
If a class action or other collective legal route is legally viable, those affected should be able to explore it. The state must not be above accountability.
This is not about dismissing genuine victims or undermining the seriousness of sexual offences. It is about upholding a principle that must apply to everyone: no person should be convicted without a fair trial, and no potentially unsafe conviction should escape proper scrutiny.
The Supreme Court's ruling is a reason to examine the system carefully, not to prejudge every individual case.
If mistakes have been made, they must be acknowledged. If rights have been infringed, there must be appropriate remedies. And if innocent men have been wrongfully convicted, they deserve the opportunity to seek justice.
A justice system must be brave enough to examine its own failures. Accountability is not an attack on justice — it is an essential part of it.
